Smithfield Township follows the process outlined in Pennsylvania’s Right-to-Know Law, Act 3 of 2008. Questions regarding this policy should be directed to the Agency Open Records Officer Julia Heilakka, Smithfield Township at (570) 223-5082 ext. 9.

1. Requests must be made in writing on the form provided by the township or the State to pursue the relief and remedies provided for in the Right-to-Know Act. Smithfield Township does not accept anonymous requests.

2. Once submitted, the Agency Open Records Officer has five business days to respond to the Right-to-Know request. All written requests shall be sent to Smithfield Township using the following contact information:

3. If a written request for records is granted, the following fees may be charged to the request per Section 1307 of the RTKL:

Copies*:

  • 8.5" x 11" copies - $.25 per page
  • 8.5" x 14" copies - $.25 per page
  • 11" x 17" copies - $.25 per page
  • All other sizes - actual cost
*Copying fees may be assessed due to redactions, even if electronic copies are requested. "Redaction" is the eradication of a portion of a document while retaining the remainder where the public record contains information subject to access as well as information not subject to access. If any information is redacted, the AORO must state what information was withheld and why.

"Pass Through" Costs: these are actual costs incurred by the township that can be passed on to the requester, which include but are not limited to:

  • Postage
  • Storage Media (flash drives)
  • Outside copying fees for blueprints/high capacity jobs
The Township may require a requester to prepay an estimate of the fees listed, if the fees required to fulfill the request are expected to exceed $100. All costs must be paid by certified check or money order made payable to “Smithfield Township.” For the entire, updated fee schedule, click here.

Timeline for Filing an Appeal

If a written request is denied or deemed denied, the requester has fifteen (15) business days to file an appeal from the mailing date of the agency's response or the date that the request was deemed denied. For in-person submissions and submissions via postal mail, the deadline is 5:00 p.m. on the 15th business day.
